Lifestyle Adventures Asia | Yacht Charter Terms and Conditions:
For ease of reference, the abbreviations and short hands are as follows:
“LAA” refers to Lifestyle Adventures Asia
“Agent” refers to appointed agents authorized to see and represent the charter by LAA
“Charter” refers to the agreed charter to be operated by LAA which as been directly booked through LAA or its appointed Agent
“CA” refers to the Charter Agreement which is a combination of the LAA Terms and Conditions “LAATC” and the Charter Confirmation and Charter Receipt “COCR” which is entered into by the Charterer. For sake of dispute, the LAA terms and Conditions prevail over all agents Terms and Conditions when the charterer boards the vessel.
“Price” refers to the agreed price for all services offered directly by LAA or its assigned agents
“Charterer” refers to the person who charters the yacht and accepts full responsibility for the charter and the guests invited by the charterer
“Guests or Pax” refer to the total amount of guest or pax (passengers) that are invited by the charterer and covered in the COCR
“Deposit” refers to the required deposit of funds from the total fees charged to a Charterer which is 50% unless previously agreed in writing.
“COCR” refers to Confirmation of Charter & Receipt issued by LAA or its assigned Agents
“Entire Period” refers to the time when the Charterer arrives, board the vessel and alight from the vessel at the end of his/her scheduled charter
“Agreement” refers to this document titled Terms and Conditions
“GST” refers to the Goods & Services Taxes required to be paid by the charterer or its agents to LAA.
“Vessel” is the authorized vessel owned and operated by LAA under the Singapore Laws for charter.
Price is inclusive of fuel required for the charter within Southern Islands of Singapore, any part further out of that may apply extra fuel charges.
Bookings must be made through LAA or its authorized agents and all bookings are subject to availability.
All departures are from main berth pick-up area, Keppel Bay Marina, Singapore unless previous arrangements made. Additional cost may be apply for departure /arrival at other marinas.
Reservation of yachts can be made by way of online booking, telephone booking or walk-in.
All reservations will be accepted on a first come first serve basis, upon receipt of the Deposit.
The period and fees associated with chartering of our yachts shall be provided in the COCR.
In order to accept confirmation of reservation, a deposit of fifty (50) percent of the total fees specified in the COCR (“the Deposit”) is required. The Deposit is non-refundable in some circumstances. Full payment is required at least 48 hours prior to departure.
The charter rental shall be forfeited in the event of a no-show i.e. where you and/or your guests do not show up for the scheduled time for chartering of our yacht in accordance with the LAATC and COCR provided to you.
Cancellation of reservation is not allowed at any point of time after the issuance the COCR unless reasons for cancellation are given and are deem reasonable. The Deposit shall be forfeited in the event of cancellation.
Rescheduling of confirmed date for Cruise Charters will be subject to 25% administrative fees on above charter rates.
Rescheduling of confirmed date for Cruise Charters lesser than 5 days from the original confirmed date will not be approved.
Rescheduling of confirmed date for Cruise Charters is subject to availability
In the event of bad weather or due to technical fault for Cruise Charter activities:
Condition 1: The captain, in his reasonable opinion declares that the sea conditions are not suitable for the charter two hours before the scheduled yacht charter and there is a reasonable possibility of danger to the yacht and personnel; or
Condition 2: Heavy rains exist at Marina and it is determined in the reasonable opinion of the Captain and the Dock master, that at least 75% of the charter time will be affected by heavy rain two hours before the scheduled yacht charter and there is no reasonable possibility of danger to the yacht and personnel; or
Condition 3: The yacht charter has commenced and in the reasonable opinion of the
Captain, bad weather conditions do not permit the continuation of the cruise and that at least 75% of the charter time will be affected and there is a reasonable possibility of danger to the yacht and personnel.
Under Condition 1, the Captain will cancel the charter due to safety concerns for the passengers and yacht.
Under Condition 2, the Captain will give the passengers the option to continue with the charter or to cancel the charter.
Under Condition 3, the Captain will cancel the charter and passengers will have the option to arrange for another yacht charter at 50% off the mandatory charter fee of your actual charter fee.
A full refund of the charter fee will be given for both conditions 1 and 2 for overseas bookings where the charterer only has a confirmed air ticket leaving Singapore and cannot complete the charter within one month.
All other charters would be available for the charterer to re-confirm an alternative date for another yacht charter within a one (1) month period from cancellation
All charters die to a technical fault, LAA will return 100% of the charter fee to the charterer or give the option for the charter to re-book. If a re-booking occurs, LAA will offer a 20% discount on the charter in good faith.
You shall be responsible in ensuring that you and your guests do not cause any damage whatsoever to the chartered yacht during the Entire Period of the charter and responsible for any damage (if any) caused to the yacht that is attributed to the acts and/or omissions of you and your guests during the Entire Period of the charter.
You agree to indemnify us for all liabilities to the fullest extent permitted by law. Accordingly, you shall not hold us liable for any liabilities, including but not limited to accidents, personal injuries, damages or losses attributed to the acts and/or omissions of you and/or your guests during the period of chartering of our yacht
You shall be responsible to ensure that you have reached the age of majority and have the legal capacity to enter into this contract and execute the relevant transaction for chartering of our yacht(s)
You shall be responsible in ensuring that you have arranged suitable and adequate personal travel insurance to cover the entire period chartering of our yacht.
You shall not assign or sub-charter our yacht in the event in our absence of our knowledge and consent.
Smoking inside the yacht is strictly prohibited for safety reasons. A designated smoking area on the yacht will be briefed to the Charterer and his/her guests during the visit of charter.
Lifestyle Adventures Asia reserves the right to cancel/terminate any Cruise or Berth Charter in the event of any unforeseen circumstances. In such a case, full Deposit amount shall be refunded to the Charterer therein. You hereby agree to indemnify Lifestyle Adventures Asia against all claims, losses or damages resulting from the cancellation.
The terms and conditions set out herein shall be governed by and construed in accordance with the laws of Singapore. Any dispute or issue arising out of, or in connection with this Agreement shall be dealt with by the Courts of Singapore.
By agreeing to the charter, you have accepted the terms and conditions of the charter above. You have read thoroughly the above and hereby agree to the terms set out above by Lifestyle Adventures Asia.
